Terms of Use

These terms are the agreement between you and Southbound Software, the trading name of a sole proprietor based in Kentucky, USA, covering the Matteshot software and the matteshot.app website. By installing or using Matteshot you accept them. If you do not, do not install it.

"Matteshot", "we", and "us" mean Southbound Software. "You" means the person or organization using the software.

1. The trial

Matteshot includes a 14-day trial with no card required. The trial begins with your first completed capture, not when you install, so installing and leaving it alone does not spend it. The trial is the full product; nothing is held back.

Trial length is enforced against a clock on our server and against a record tied to your device, so that reinstalling or resetting local files does not start it over. Deliberately circumventing this is a breach of these terms.

When the trial ends the app stops capturing until a license is activated. Files you already created remain yours and stay on your PC.

2. What you get when you buy

A purchase grants you a perpetual, non-exclusive, non-transferable license to use Matteshot, with:

The license is for you or your organization. It is not a subscription and there is nothing to cancel.

Matteshot is licensed, not sold. We keep all rights in the software itself. You keep all rights in everything you make with it. Your screenshots, recordings, and edits are yours, and we claim no interest in them and no right to use them.

5. Updates and changes

Matteshot can update itself. Updates are signed and the app verifies both the signature and the published checksum before installing anything. We may add, change, or remove features between versions. If a change would materially reduce what the product does, we will say so in the release notes.

6. Payments

Purchases are processed by Lemon Squeezy as merchant of record. Your purchase is also subject to their terms, and any tax is handled by them. Refunds are covered by our refund policy.

7. Privacy

What the software collects, and how to switch analytics off, is set out in the privacy policy, which forms part of these terms.

8. No warranty

Matteshot is provided "as is". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error free, or compatible with every configuration of Windows, hardware, or third-party software.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only so far as that jurisdiction permits, and your statutory rights as a consumer are unaffected.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of or inability to use Matteshot.

Our total liability to you for any claim is limited to the amount you actually paid for Matteshot in the twelve months before the claim. If you have not paid us anything, our total liability is limited to fifty US dollars.

Nothing here limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.

10. Ending the license

Your license ends if you materially breach these terms, in particular section 3. You can end it at any time by uninstalling Matteshot. Sections 4, 8, 9, and 11 survive the end of the license.

We may deactivate a license that was obtained fraudulently, charged back, or refunded. A refund and a working license are alternatives, not both.

11. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to its conflict of law rules, and the state and federal courts located in Kentucky have exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your country of residence.

12. General

If any provision is held unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them as part of a transfer of the business. These terms, together with the privacy and refund policies, are the entire agreement between us about Matteshot.

We may update these terms. The date at the top shows when they last changed, and the version in force is the one published here when you buy or use the software.
